Google Faces Trial Over Its Control in Digital Advertising

A major trial has begun to determine if Google Monopoly has too much power over the online advertising industry. The U.S. government and attorneys from eight different states have filed a lawsuit, claiming Google dominates the market unfairly. This case, now being heard in a Virginia court, could change the digital advertising world if Google is found to hold a Google monopoly.

Why the Government is Suing Google

The lawsuit was filed in January 2023 by the U.S. Department of Justice along with attorneys general from states like Virginia, California, and New York. Their argument is that Google controls a huge portion of the digital ad market. They say Google not only controls the tools used to buy, sell, and display ads, but it also manipulates the prices and services that ad buyers need to use.

Google’s control of these tools gives it an unfair advantage, according to the lawsuit. The states believe this harms competition and makes it harder for other companies to succeed in the advertising industry.

Google’s “Trifecta of Monopolies”

In her opening statement, Julia Tarver Wood, a lawyer from the Justice Department, explained that Google has what she called a “trifecta of monopolies” in the digital ad space. This means Google controls three main areas:

  1. The ad server business for publishers,
  2. Its AdX advertising exchange, and
  3. Its advertiser ad network.

Wood claimed that these three areas are so interconnected that they all lead back to Google, leaving little room for other companies to compete fairly.

Google’s Defense: It’s All About Innovation

Google’s legal team argues that the company is not breaking any laws. According to Karen Dunn, Google’s attorney, Google’s success comes from its innovation and investments in online advertising tools, not from unfair practices. Dunn also mentioned that other large companies, like Meta (formerly Facebook), Amazon, and Microsoft, offer similar advertising tools, proving that Google isn’t the only big player in the market.

Google’s defense is centered around the idea that competition is alive and well in the digital advertising space, and that the company has made the entire industry better with its advancements.

Recent Legal Troubles for Google

This trial is just the latest in a series of legal challenges that Google has faced. Recently, a federal judge ruled that Google had violated antitrust laws to maintain a monopoly in the search engine market. While no penalty has been issued yet, this ruling shows that the courts are not afraid to act against Google’s business practices.

Additionally, in December, Google agreed to pay $700 million and change its mobile app store policies to allow users to make purchases using non-Google payment options. This settlement was another hit to Google’s control over different areas of its business.

In fact, analysis firm eMarketer estimates that Google will make $77.49 billion from digital advertising this year alone, accounting for about 25% of the total ad market.
